Mortgage Forgiveness of Debt Relief Act of 2007
There is a three year exception which will allow debt forgiveness on qualified home loans, retroactive to January 1, 2007 (therefore it applies to 2007-2009). Debt forgiveness is often a result of foreclosure action. Without this "forgiveness", tax could be due on the "income" deemed to occur when the burden of debt is lifted.
Note: However this new law does not apply if the taxpayer is in Chapter 11 bankruptcy.
